The internationally binding contractual basis is the Convention of the Council of Europe on the Transfer of Sentenced Persons (Treaty Series 13/1987, ETS 112). Finland has made a declaration concerning this Convention: when applying the Convention, Finland uses the word national as referring to the nationals of the state of enforcement and to foreigners habitually residing in that state.
The Agreement between the Government of Finland and the International Tribunal for the Prosecution of Persons Responsible for Crimes Committed in Former Yugoslavia on the Enforcement of the Judgments of the Tribunal (Treaty Series 27/1997) is related to the transfer of sentenced persons. The same question is regulated by the Act on the Jurisdiction of and Legal Assistance to the International Tribunal for the Prosecution of Persons Responsible for Crimes Committed in Former Yugoslavia (12/1994). This arrangement makes the enforcement prerequisites less rigid.
