The proposals for Acts and Decrees, drafted in the ministries, go through a legislative inspection in the Bureau of Legislative Inspection at the Ministry of Justice, before they are submitted forward for decision-making.
The inspection is obligatory. It may can be skipped only if the matter is exceptionally urgent. Inspection of a proposal for a Decree may be skipped also if the matter is of minor significance.
Finland is a bilingual country and therefore the proposals are submitted for inspection both in Finnish and in Swedish.
In the inspection it is checked that the proposal is drawn up in compliance with the instructions for legislative drafting, i.e. the Bill Drafting Instructions, the Legal Drafter's Manual, the Legal Drafter's Guide to the European Union and the Legal Drafter's Guide to the Constitution.
In the inspection it is checked that:
1. the name of the proposal corresponds to the content,
2. the preamble is in compliance with the prevailing standard and corresponds to the content,
3. the technical structure of the proposal is correct,
4. the references to other parts of the proposal and other provisions are correct,
5. the content of the proposal is consistent and
6. the proposal is in accordance with general legal principles and other provisions on the same or similar matters.
Special attention is also paid to that the proposal is linguistically flawless, comprehensible, precise and consistent and that the content of Finnish and the Swedish text is identical.
The inspectors make necessary corrections to the proposals and comment on possible shortcomings. If a proposal proves out to be so insufficient that necessary corrections can not be made in connection with the inspection, it is sent back to the drafter. The drafter is notified of the deficiencies and flaws. When these are corrected the proposal must once again be submitted to the Bureau for inspection.
